These terms and conditions apply to the use of the Little Nitwits website. By placing an order with us, and by accessing this website, you are agreeing to accept these terms and conditions, together with the privacy policy which is hereby incorporated by reference.

Please note, these terms and conditions can potentially change at any time, and it is your responsibility to check them regularly before ordering products in case there are any changes. If you do not agree with the terms and conditions set out below, you should not use or access this website.

Payment

You confirm that you are over 18 years of age and a UK resident. You may pay for your order using the following cards: Visa, MasterCard, Maestro and Solo.

All transactions are in £ Sterling and are inclusive of any applicable British sales tax (VAT).

A Present, for me…..?

If you are treating a little person to this, we will happily put it in a smart stripey gift box…. And we’ll handwrite your ‘sheep shaped’ note too…. This will cost an additional £4 and we’ll pop the invoice in the post to you.

Exchanges, Refunds and Cancellation.

We hope you are delighted with your goods.

Our clothing is made with great care, and we put a big effort into quality control. However, if you want to Exchange your item or obtain a Refund, you must return the item within 14 days of our dispatch, unworn, in saleable condition and in its original packaging. Please advise us of the reason for the return and whether you would like a Refund or Exchange.

As with all woollen items, it is very important that the care instructions are fully complied with, in order that they retain their original shape, colour and texture for as long as possible. Items therefore cannot be exchanged or refunded where you have failed to follow the care instructions (this is the same for the felt ‘Fun Pack’ characters). If you return an item to Little Nitwits that Little Nitwits determines has not been properly cared for, you do so at your own risk. If you would like the item to be returned to you again, please contact Little Nitwits. Please note that you will be charged postage and packaging for its return.

Please note that items bought on sale or as part of a special offer can only be returned for Exchange or Refund where they were delivered with a fault. In such circumstances, a Refund or Exchange will be provided where you have notified us promptly of such fault, and the item is returned within 14 days of dispatch, in an unworn condition and its original packaging.

We cannot be responsible for goods that fail to reach us, so please obtain a proof of posting from your post office, or send the item back to us via recorded delivery. We are not responsible for return postage or packaging, (however if you included a postal receipt for a faulty good, we will refund the cost to you) but we will work hard to sort out your Refund or Exchange asap. Full returns details are found on the dispatch note included in your parcel.

Please note that if you decide to Exchange your items for something different, you may find there are changes to the delivery timescale or to the postage and/or the price you pay for the item (you’ll be charged the current selling price on the day you cancel or amend the order). Exchange orders are processed on receipt of the returned items and your replacement item will be dispatched within the next 5 working days of receipt, provided the item is in stock. If it is not in stock, you will be advised by email of the expected delivery date.

Where a Refund is requested, payment for the returned item will be credited back to you in the same way that you paid for the items. Refunds are processed as soon as possible, generally within 10 days of receipt of the returned item, provided it is unworn, in saleable condition and in its original packaging.

Under the distance selling regulations, you have the legal right to cancel your order at any point up to seven working days from the date of receipt of the goods. If you do wish to cancel your order, please let us know as soon as possible by contacting us by email: info@LittleNitwits.co.uk. Any money debited from your credit card will be Refunded in the same way described above, once any dispatched goods have been returned to Little Nitwits (again, in unworn, resaleable condition and in original packaging).

Little Nitwits Limited shall not be liable for any consequential loss whether this arises from breach of duty in contract or any other way. Liability for any claim shall not exceed the price of the goods supplied. This does not affect your statutory rights.

Every care has been taken to ensure that the description and specification of our products on the website are correct at the time of going to press. However, while the colour of design reproduction is a close representation, a very slight variation in the actual goods may occur.

Competitions Rules, Terms & Conditions

1. The winner of the prize will be the first drawn subscriber to the Competition only.

2. The draw will take place within 1 day of the closing date.

3. The winner will be notified by email immediately after the draw takes place.

4. In all matters the decision of Little Nitwits is final and no correspondence can be entered into.

5. Each individual registration made will qualify as one entry into the draw.

6. Employees of Little Nitwits and its associated companies and agents are not eligible to enter.

7. The prizes must be taken as offered and there will be no cash alternative.

8. Entering this prize draw indicates a complete acceptance of these rules

All our clothes and toys are made to the highest standards and are fully tested.
The ‘Fun Pack’ Friends meet all the toy standards regulations, EN71.

All rights, including copyright, in this website are owned by or licensed to Little Nitwits Limited. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without the permission of Little Nitwits. You may not modify, distribute or re-post something on this website for any purpose.

Accuracy of content

Little Nitwits has taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at time of publishing and all products have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. All prices are displayed inclusive of VAT. Packaging may vary from that shown. To the extent permitted by applicable law, Little Nitwits disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Little Nitwits shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.

Password/account security

When ordering your “Little Nitwits”, you will be asked to create an account, with a unique user name and a password. You are responsible for maintaining the confidentiality of your password and account and any activities that occur under your account, so please make every effort to make sure your password is kept safe and do not disclose it to anyone. If you believe it has been compromised, you must change it. If there are any changes to the details you provide us, it is your responsibility to let us know as soon as possible in writing. Little Nitwits shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. You warrant that all details you provide to Little Nitwits for the purpose of ordering or purchasing goods are true, accurate, current and complete in all respects; and that the credit or debit card you are using is your own and that there are sufficient funds in your account to cover payment of the product(s) ordered.

Waiver

No waiver by us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Survival

Each provision of these terms and conditions shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

Entire agreement

These terms and conditions govern our relationship with you. You confirm that, in agreeing to accept these terms and conditions, you have not relied on any representation save insofar as the same has expressly been made a term of these terms, and you agree that you shall have no remedy in respect of any representation.

Liability

Nothing in these terms and conditions shall limit or exclude our liability in respect of:
• any fraudulent or negligent misrepresentation, whether or not such has become a term of these terms and conditions; or
• for death or personal injury resulting from our negligence or that of our servants, agents or employees

We make no warranty that the website will be uninterrupted, timely or error-free, or that the website or the server that makes it available are free of viruses or bugs. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products sold through this website. This does not affect your statutory rights as a consumer.

Termination

Little Nitwits reserves the right to terminate our agreement with you and to suspend or
terminate your access to the website immediately and without notice to you if:
• you fail to make payment to us when due
• you breach any of our terms and conditions
• when requested by us to do so, you fail to provide within a reasonable time frame, sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity we suspect you have engaged, or are about to engage, or have way of being involved in fraudulent or illegal activity.

These terms and conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
